Apple Vs Motorola Mobility: U.S. Judge Dismisses Apple Patent Licensing Lawsuit | TechCrunch.
In asking a Judge to reverse her dismissal, with prejudice, of its FRAND suit against Motorola, Apple has devised a novel legal strategy. Hey, Judge, we aren't going to be bound by any ruling you make, if you rule we have to pay more than $1 per device. Uh, say what? The Judge let Apple know that she would not have a trial, merely to be an advisory rubber stamp to Apple's position. While FRAND requires Motorola to be fair in establishing licensing fees to Apple for its patents, Apple doesn't get to be the arbiter of what those fees should be. If Apple doesn't believe Motorola is treating it fairly, it has the right to go to Court. Apple wants to be Judge and Jury. Duh. Is there no limit to Apple arrogance?
