Link: Police Blotter: Did blogging juror affect DUI trial? | CNET News.com.Scalesofjustice Well, I guess it had  to happen. Jurors blogging about cases during the trial. Go figure. And, the Judge, in his discretion, denied an appeal based on juror misconduct. Does blogging constitute improper activity by a blogger/juror? The appeals court found that the trial judge was in the best position to answer the question; however, as much as I love live blogging (I have done it myself, but not during a trial), I have to compare it to jurors discussing the case with third parties outside of the courtroom and deliberations. A reporter blogging during trial is just a spectator. This juror  had a conflict of interest. The Court here rightly held that post trial blogging could not be prevented, and was proper. It is hard to see how in-trial blogging before an opinion is reached, by a juror whose job it is to assess credibility, can be permitted in a society that wants decisions made in courtrooms, after hearing all the evidence.

I Heart Tech - Useful AND Beautiful

Link: I Heart Tech.Ihearttech Like its author, IHeartTech is useful AND beautiful. I met Adriana Linares in 2005 at the BlawgThink Unconference in Chicago. I have followed her tech blog ever since, and find something useful in it all the time. The blog has a feminine touch, with an extensive knowledge of computer technology, and is the best out there for step by step solutions to computer tasks. My favorite currently is the creation of digital signatures. Adriana spends her days helping law firms with technology; I remember the pain of showing an attorney how to do it, and receiving an antedeluvian response like: "I would rather use pen and paper". Adriana, you can have the tech consulting life all to yourself. Have fun.

BLAWGWORLD 2007 - They Picked the FutureLawyer?

Blawgworld_tilt_c1_free_350BlawgWorld 2007 Link Well, Hell has frozen over. The swallows have abandoned Capistrano. Santa Claus has gone on strike. The FutureLawyer has joined the club of legal bloggers chosen to be featured in the annual TechnoLawyer book of legal bloggers. While I am honored to be among the elite, I am reminded of Groucho Marx, who opined that he wouldn't join a club that would have him as a member. But, here I am, and I have to make the best of it. You can download an interactive PDF version here . I really like most of the highlighted blogs, and you can learn something from all of them. This year, the folks at TechnoLawyer have outdone themselves. They have added a second EBook, called Problems and Solutions, that has tips and tricks to make you a better and more efficient lawyer. Even the FutureLawyer. Somehow, though, I don't think there will be thousands of people standing in line at Midnight waiting to read our blogs. But, what are you going to do? It's always something.

Staring at Strangers

Add a strange penchant for staring at strangers. What do you get? A fascinating new blog by Jennifer Rose, long-time editor of the ABA's SoloLawyer Magazine, and David Leffler, New York business law attorney. The back and forth between the two should provide interesting insights into the conflicts and comparisons between the big city and the country that ignorant Americans consider no more than America's back yard. My take on this is that regular reading of this blog will result in a more human view of the big city, and more appreciation of the sophistication of our southern neighbor.

Link: LexBlog Blog : General counsel uses blog to comment on pending litigation.Megaphone2 Kevin O'Keefe reports about the General counsel of Cisco commenting on the pending litigation with Apple over the IPhone trademark. I am bowled over by this new use of the blogging tool. It is risky enough to speak to the news media (print and broadcast) when involved in pending litigation. The legal minefield of broadcast journalism is littered with the bodies of litigants who said the wrong thing, or who got gored by a sound bite. The much more powerful new media of blogging can reach so many more people, in a viral, uncontrollable way. I wonder what Cisco's lawyers say about this? On the other hand, much high profile litigation involves the manipulation and control of media, and "getting one's own story out" is an essential part of high stakes litigation nowadays. At least the blog can be edited and controlled by the company involved. Either way, those who said blogging was a passing fad are clearly living on another planet.

Link: Home Office Lawyer. Let me introduce you to Grant Griffiths, a Kansas lawyer who publishes the home office lawyer blog. Grant is a man after my own heart, in that he believes in the power of technology to free the practice of law from the constraints of the traditional office. However, he is one of those weird Mac users. Talking to a Mac user is like talking to "She Who Must Be  Obeyed". You never know whether you are communicating. :-)

The Korea Times : Courts Test Internet Trials - Trial by Blog?

Link: The Korea Times : Courts Test Internet Trials.Courtroom Okay, I want this in the U.S. Korea is toying with the idea of conducting some trials by blog posting. I would love to file Motions and pleadings and to make oral argument in my blog. Korea, with a 70% Internet penetration, one of the largest in the world, plans to allow parties to submit evidence, legal documents and other data on Weblogs to be operated by the Court. Decisions will also be announced online. Why aren't we using our technology like this in the U.S.? I can't even get the Courts to use Webcams for Motion hearings. Judge Kim Sang-Jun of the Seoul Administration Court believes that Internet based trials will help public understanding of the legal system. We have Court TV over here, why not Internet based trials? Just wondering...

Seriously, I am live blogging from my Palm Treo while waiting for the Lightning-Capitals hockey game to begin. How better to kill time waiting for the Zambonis to finish readying the ice? For those of you in cold climes, laughing at we Floridians who watch Hockey in the Sunshine State, I remind you that the Lightning own the Stanley Cup. If I can do this with a phone, what excuse do you have for not providing your own expertise to your clients on your own blog?

In the "I am sometimes glad I am a solo practitioner, and not a Government lawyer" category, here is a follow-up article in the New Jersey Law Journal about David Lat, the Government lawyer forced to take down his site "Underneath their Robes", which blogged about judges in the Federal Judiciary. The reason given was that Federal employees have to get approval before speaking to the media. I guess the moral is, stay anonymous (apparently, Lat outed himself because he wanted credit for his work) , and blog away. As lawyers, we learn early that we need to choose our words carefully, especially when we put them in writing. As the poet Emily Dickinson said: "A word is dead when it is said, some say. I say it just begins to live that day". Words can live a long time on the Internet, and, unlike wine, they don't necessarily improve with age.

Be careful what you say in a weblog, unless you REALLY don't care who finds out. I don't like anonymous postings, anyway. If you can't say it with your name attached, you shouldn't be saying it in the first place.
