Court allows search of text messages on pager | Reuters. EDiscovery just got a lot more relevant and interesting. The U.S. Supreme Court has ruled that, at least insofar as electronic devices owned by employers, employees had no reasonable expectation of privacy in their text messages, and that they were discoverable. It is likely that these kinds of discovery disputes will increase, as parties to litigation jockey for advantage and information. In the meantime, remember Rick's Mom. Don't text or email anything you wouldn't mind being on the front page of the local newspaper.
