Execupundit.com: Disciplinary Conversation: It's Not About You.
This conversation between fictional clients of Execupundit centers on two corporate types who are worried about terminating some employee who has screwed up. They discuss what the company lawyers will think, and they ponder that the lawyers are always nervous. I wonder why? Could it be that it is next to impossible these days to predict legal outcomes from fact patterns? Everything I do every day is a judgment call, it seems, and, if my judgment turns out to be wrong, it somehow is blamed on me. I know, that is the lawyer's job; but, we don't create bad fact patterns. Clients do. And you wonder why the lawyers are always nervous? It's a dirty job; but, somebody has to do it. Now, where do I send the bill?
