After the Redskins trademark was restored, and is now safe from the easily offended, The Lanham Act's provision banning "immoral" or "scandalous" trademarks has been invalidated by the Supreme Court, in Iancu v. Brunetti, which struck down the 100 year old provision. The provision of the the Trademark Act of 1946, which "prohibits registration of marks that may disparage persons or bring them into contempt or disrepute", had previously been struck down. It would appear that free speech is still alive; at least, in trademark law. Hail to the Redskins.
